Terms of Service
Appropriate Use of Services:
Services provided by Divas Edge may be used for lawful purposes only. No services are provided to sites containing pornography or related material, or material in violation of any Federal, State or City law. You must agree not to use any services provided by Divas Edge in any unlawful manner.
We reserve the right to remove any and all materials which infringe on copyrighted work. Such materials may be removed at any time upon receiving a complaint and/or notice of alleged copyright infringement. We reserve the right to suspend or terminate accounts engaging in activities, whether lawful or unlawful, that we determine to be harmful to our clients, operations, reputation, goodwill, or customer relations.
Divas Edge reserves the right to refuse or cancel services at any time in the case of a violation of the terms of service as found on this page.
No Warranty; Limitation of Liability:
Use of Divas Edge's services and system and the Internet in general is at the user's sole risk. We do not warrant that our services and system will be uninterrupted, error free, free from unauthorized intrusion, or that Divas Edge's services or system will meet any particular criteria of performance or quality; nor do we make any warranty as to the results or information obtained from use of its service or system or the Internet in general. Divas Edge's services and system are provided on an 'As is', 'as available' basis without warranties of any kind. We will not be liable for damages resulting from the use or inability to use all or any part of our system or services, deletion or loss of files or e-mail, viruses, any delay or failure of performance, or unauthorized access to records or files.
Client Liability and Indemnification:
The client agrees to indemnify and hold harmless Divas Edge Web Design from any claims resulting from the use of the service which damages the customer or any other parties.
Payment Obligations:
Payment must be made by check, cash, money order, or credit card. We accept Master Card, Visa, and American Express for credit card payments. Small projects must be paid in full before work begins. For larger projects, we require you to pay 50% upon contract signing and 50% upon completion and approval of your project. You must agree to supply appropriate payment for all services received from Divas Edge.
No additional charges outside the initial package agreement will apply unless circumstances cause a need and will NOT be added without consent from the Client.
Suspension/Termination for Non-payment:
We will send invoices out each month. Payments not made within 30 days of billing date are considered delinquent. Delinquent accounts are subject to immediate suspension and/or termination without notice. Once your account is terminated, all data is lost and a new account would need to be established.
Client's canceling services in the middle of a billing cycle will not be eligible for a refund. Termination or suspension does not release liability for charges due. We may delete all data, files or other information that is stored in client's account of hosted Web site upon termination.
Divas Edge reserves the right to change or update policies without notice.
